The sanctity of the contract prevails…
On Wednesday, a New York Judge completely threw out Kesha’s legal attempt to invalidate her contract with Sony Music Entertainment and Dr. Luke over ‘slavery’ allegations and sexual assault. The legal battle has been ongoing for a year and a half and is finally drawing to a close.
In 2014, Kesha filed a lawsuit against Dr. Luke alleging that he sexually and mentally abused the artist since the age of 18. Kesha also filed a lawsuit against Sony Music for not allowing her to vacate her contract (in response, Sony offered to continue the contract with a different producer).
Manhattan Supreme Court judge Shirley Kornreich denied a preliminary injunction that would have seen Kesha free of her contract with Sony, but shortly after Kesha filed an appeal. That motion was quickly denied, especially in light of Sony’s concessions to accommodate another producer.
The New York judge has now thrown out most of Kesha’s allegations aside from the rape and sexual assault allegations. Those are serious charges, but they don’t justify a nullification of the contract under New York State law.
Also, as the alleged sexual abuse took place in 2008, the judge found that the allegations were outside the court’s jurisdiction due to statute of limitations. Meanwhile, Dr. Luke and his record label Kemosable Records have countersued Kesha on the grounds of defamation and breach of contract.
